Terms of service

The agreement between you and ClaimSpy. Written to be read — if a clause here is unclear, that is a bug, and we would like to hear about it.

The short version

Use ClaimSpy to monitor public marketing pages. Do not use it to break into anything. Paid plans bill monthly and you can cancel any time, effective at the end of the period. We make no promise that a ClaimSpy record is admissible as evidence — that is for your jurisdiction and your counsel to decide.

1. The agreement

These terms govern your use of ClaimSpy, at claimspy.io and app.claimspy.io. By creating an account you accept them. If you are accepting on behalf of a company, you confirm you are authorised to bind it.

2. What the service does

ClaimSpy visits the public marketing pages of domains you nominate, extracts the marketing claims on them, tells you when those claims change, and keeps a dated record of each capture. Some captures carry an RFC 3161 time-stamp from an independent authority.

What it does not do: access anything behind a login, defeat access controls, or collect personal data about individuals. Our crawler's behaviour is documented in full in the crawler policy.

3. Your account

  • You are responsible for what happens under your account and for keeping your credentials secure.
  • Seats are per named person. Sharing one login across a team is not permitted; your plan's seat count is there to be used.
  • You must give accurate signup information and keep your billing address current.

4. Acceptable use

You agree not to:

  • Nominate a domain in order to harass its owner, or to gain unauthorised access to it.
  • Use ClaimSpy to collect personal data about individuals.
  • Resell, white-label or redistribute ClaimSpy output as your own monitoring service without a written agreement with us.
  • Attempt to circumvent plan limits, reverse engineer the service, or interfere with its operation.
  • Use the service in breach of any applicable law, including data protection and competition law.

We may suspend an account that breaches this section. Where the breach is not serious we will ask you to fix it first.

5. Plans, billing and cancellation

  • Plan limits — domains, pages per crawl, refresh frequency and seats — are shown on the pricing page and enforced in the app.
  • Paid plans bill monthly in advance. Prices are in US dollars and exclude any sales tax or VAT, which is added at checkout where applicable.
  • Cancel any time, from the billing page in the app. Cancellation takes effect at the end of the period you have paid for; we do not pro-rate partial months, and we do not make you email us or sit through a retention call.
  • We may change prices with 30 days' notice by email. A price change never applies to a period you have already paid for.
  • If a payment fails we will retry and email you. Persistent failure downgrades the account to Free rather than deleting it.

6. Your data, and who owns what

You own the data you put into ClaimSpy — your tracked domains, settings and notes — and the claim records generated for your account. You can export them at any time, and you can export them on the way out.

We own the software, the interface and the extraction models. Nothing here transfers any of that to you.

We may use aggregated, de-identified statistics about service usage to improve the product. We do not use your tracked-competitor list, or the identity of the domains you watch, for any purpose other than delivering the service to you.

7. Evidence and time-stamping — what we do not promise

ClaimSpy produces time-stamped, tamper-evident capture records. We describe the method precisely and we do not overstate it. In particular:

  • We do not warrant that any ClaimSpy record is admissible in any court, tribunal or proceeding. Admissibility depends on your jurisdiction, the rules of evidence that apply, and the judgement of your counsel.
  • Where a capture could not be time-stamped, the record says so. An unstamped capture is not presented as a stamped one.
  • Claim extraction is automated and imperfect. It may miss a claim, or read one incorrectly. You should verify any claim you intend to rely on against the linked capture before acting on it.

8. Availability

We aim for high availability but do not offer a contractual uptime guarantee on self-serve plans. Crawls can be delayed by a target site being slow, unavailable, or newly blocking our crawler; a missed crawl is not a service failure. We may perform maintenance with notice where it is likely to be disruptive.

9. Warranties and liability

The service is provided "as is". To the maximum extent permitted by law we exclude implied warranties of merchantability and fitness for a particular purpose.

We are not liable for indirect or consequential loss, loss of profit, or loss of opportunity. Our total liability in any 12-month period is limited to the amount you paid us in that period.

Nothing here limits liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot lawfully be limited. If you are a consumer, your statutory rights are unaffected.

10. Termination

You may close your account at any time. We may terminate for material breach of section 4, or with 30 days' notice for any reason. On termination you keep the right to export your data for 30 days, after which it is deleted in line with the privacy policy.

11. Changes to these terms

We may update these terms. Material changes are emailed to account holders at least 30 days before they take effect, and continuing to use the service after that is acceptance. If you do not accept a change, cancel before it takes effect and we will refund any unused paid period.

12. Governing law

These terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction, without affecting any mandatory protection you have under the law of your country of residence.
